Q: I am married to a British citizen, have a UK Spouse visa and was granted Indefinite Leave to Remain two months ago. We are currently experiencing problems in our marriage and I am considering a divorce. How will this affect my status in the UK? Will I still be able to apply for British citizenship?
A: Once you have been granted Indefinite Leave to Remain this will not be revoked if you separate from, or even divorce your spouse. You will retain your status as a permanent resident of the United Kingdom regardless of your marital status. You will also still be able to apply for British Citizenship when you become eligible. However, the date on which you become eligible to apply for British Citizenship may differ dependent on whether you are still married to your spouse.
